1. Introduction & Binding Acceptance

This End User License Agreement ("Agreement") constitutes a legally binding contract between you ("User," "You") and 2You Inc. regarding your use of the 2You mobile messaging application ("App"), associated services, and website (collectively, "Services"). By downloading, installing, accessing, or using the Services, you expressly:

• Confirm you are at least 13 years old (16 in the EU/EEA)
• Agree to comply with all sections of this Agreement, our Privacy Policy, and Apple App Store Guidelines
• Acknowledge that violation may result in legal action. IMMEDIATELY DISCONTINUE USE IF YOU DO NOT UNCONDITIONALLY ACCEPT THESE TERMS.

2. License Grant & Restrictions

2.1 Limited License

Subject to strict compliance, 2You Inc. grants you a non-exclusive, non-transferable, revocable license to install and use the App solely for personal, non-commercial purposes on devices you own or control.

2.2 Explicit Restrictions

• Reverse-engineering, modifying, or creating derivative works of the App.
• Using bots, scrapers, or automated systems to access Services.
• Circumventing App Store payment systems (e.g., iOS in-app purchases).

3. Zero-Tolerance Prohibited Conduct & Content

3.1 Illegal & Harmful Content

• Child Sexual Abuse Material (CSAM): Depictions of minors in sexual acts, implied or explicit. Grooming, sexual solicitation of minors, or distribution of exploitative content.
• Non-Consensual Content: Revenge porn, intimate imagery without consent, deepfakes or manipulated media for sexual harassment.
• Extreme Violence & Self-Harm: Graphic depictions of torture, suicide, terrorism, or real-world violence. Instructions for creating weapons or harmful devices.

3.2 Explicit Sexual Content

• All nudity/pornography is banned, including sexual acts, genitals, or sexually suggestive content involving minors.
• Fetish content promoting non-consent, incest, bestiality, or necrophilia.

3.3 Abuse, Harassment & Hate

• Threats, doxxing, stalking, bullying, or blackmail.
• Hate speech targeting race, religion, gender, sexuality, or disability.
• Incitement of violence, discrimination, or harassment campaigns.

3.4 Fraud & Illegal Activities

• Phishing, scams, pyramid schemes, or deceptive practices.
• Sale of drugs, weapons, stolen data, or counterfeit goods.
• Copyright infringement, trademark violations, or piracy.

4. App Store Compliance Requirements

• Adhere to Apple App Store Guidelines §1.1, §1.2, §4.1, §5.0:
  • No spam, fake reviews, or manipulated ratings.
  • No impersonation of individuals, brands, or entities.
  • No bypassing Apple’s in-app purchase system.
• Mandatory Reporting:
  • CSAM or exploitation attempts will be reported to NCMEC and law enforcement.
  • Apple and relevant authorities will be notified of severe violations.

5. Intellectual Property Rights

• 2You Inc. retains all rights to the App’s code, trademarks, logos, and infrastructure.
• User-generated content remains your property, but you grant 2You Inc. a worldwide, royalty-free license to host, transmit, and analyze it solely for App operation.

6. Privacy & Data Security

• Data Collection: We process data per our Privacy Policy.
• Security Measures: End-to-end encryption for messages, industry-standard safeguards for data.
• Breach Protocols: We will notify impacted users of unauthorized data access within 72 hours.

7. Termination & Enforcement

7.1 Violation Consequences

• Immediate account suspension or termination.
• Permanent device/IP bans using Apple DeviceCheck API.
• Fines up to $10,000 USD per violation for damages incurred.
• Mandatory reporting to law enforcement (e.g., FBI, Interpol).

7.2 User-Initiated Termination

Uninstall the App and email privacy@2you.chat to request data deletion.

8. Disclaimers & Liability Limits

• "As Is" Service: No warranties for uninterrupted/error-free operation.
• Liability Cap: Our maximum liability is limited to $100 USD or fees paid in the past year.
• Third-Party Risks: We disclaim responsibility for user-to-user interactions or external links.

9. Indemnification

You agree to indemnify 2You Inc. against all claims, damages, or expenses arising from your breach of this Agreement.

10. Governing Law & Dispute Resolution

• Jurisdiction: Governed by California law, excluding conflict-of-law principles.
• Arbitration: Disputes resolved via binding arbitration in San Francisco, CA (JAMS Rules).
• Class Action Waiver: No class-action or representative lawsuits permitted.

11. Updates & Modifications

13. Miscellaneous Provisions

• Severability: If any clause is invalid, the remainder remains enforceable.
• No Waiver: Failure to enforce a provision ≠ waiver of rights.
• Survival: Sections 3 (Prohibitions), 8 (Liability), 9 (Indemnification), and 10 (Disputes) survive termination.
• Apple-Specific Terms: You acknowledge Apple is not liable for App-related claims.

FINAL ACKNOWLEDGMENT

1. YOU HAVE READ AND AGREE TO THIS 10,000-WORD EULA.
2. YOU WILL NOT USE THE APP FOR EXPLOITATION, ABUSE, OR ILLEGAL ACTIVITIES.
3. YOU CONSENT TO ARBITRATION AND WAIVE CLASS ACTION RIGHTS.
